Release and Waiver of Liability
By clicking “I agree to the waiver”, I confirm that I am the individual whose application or registration is being submitted, and that I have read and understand this Waiver and Release.
I understand that this Waiver and Release is made for the benefit of Together We Golf, its founders, and each of its directors, officers, employees, volunteers, coaches, instructors, event organizers, business operators, agents, sponsors, affiliates, partners, and site property owners or occupiers (collectively, the “Organization”).
I understand that there are inherent risks (“Risks”) associated with each of the following activities (“Activities”):
• The game of golf;
• Indoor golf simulator events and activities;
• Outdoor golf events and organized rounds;
• Golf lessons, instruction, clinics and coaching sessions;
• Social golf and networking events;
• League events, including those operated through the NGL League;
• The use of golf equipment and/or power carts, whether rented, borrowed, supplied by a venue, or personally owned;
• The use of facilities utilized by the Organization; and
• Participation in sports, fitness, instruction, food and beverage services, and other activities, services, programs or events provided, organized, sponsored or facilitated by the Organization.
I am aware that the Risks include, but are not limited to:
• Physical injury caused by golf swings, golf balls, golf clubs, carts, simulator equipment, technology, structures, or collisions with other participants;
• Slips, trips, falls, and other hazards associated with indoor and outdoor golf facilities;
• Equipment malfunction or misuse;
• Property damage;
• Physical exertion, dehydration, weather conditions, and medical complications;
• Exposure to infectious diseases, viruses, bacteria, or other communicable illnesses; and
• The potential for serious personal injury, permanent disability, death, or property damage.
I understand the Risks may be relative to my own state of fitness and health (including physical, mental and emotional), and to the awareness, care and skill with which I conduct myself.
I freely accept and fully assume all responsibility for all Risks and possibilities of personal injury, death, property damage or other loss resulting from my participation in the above described Activities. I accept these Risks and agree to the terms of this Waiver and Release, even if the Organization is found to be negligent or in breach of any duty of care or any obligation to me in my participation in the Activities.
In addition to consideration given to the Organization for my participation in Activities, I and my heirs, next of kin, executors, administrators and assigns (collectively my “Legal Representatives”), agree:
• To waive all claims that I have or may have in the future against the Organization;
• To release and forever discharge the Organization from all liability for all personal injury, death, property damage or other loss resulting from my participation in the above described Activities due to any cause, including but not limited to negligence (failure to use such care as a reasonably prudent and careful person would use under similar circumstances) either passive or active, breach of any duty imposed by law, breach of contract or mistake or error of judgment of the Organization;
• To release and forever discharge the Organization from all liability for all personal injury, death, property damage or other loss resulting from any infectious disease, virus, bacterium, or other microorganism (whether asymptomatic or not);
• To release and forever discharge the Organization from all liability for all personal injury, death, property damage or other loss resulting from Coronavirus (COVID-19), including any mutation or variation thereof;
• To release and forever discharge the Organization from all liability for all personal injury, death, property damage or other loss resulting from a pandemic or epidemic, as declared by the World Health Organization or any governmental authority; and
• To be liable for and to hold harmless and indemnify the Organization from all actions, proceedings, claims, damages, costs, demands including court costs and costs on a solicitor and client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with my participation in Activities.
HEALTH AND PHYSICAL CONDITION
I represent and warrant that I am physically and mentally capable of participating in the Activities and that I have no condition that would make my participation unsafe for myself or others. If I have any medical, physical, or health concerns that may affect my ability to safely participate, I acknowledge that I am solely responsible for obtaining appropriate medical advice before participating.
RULES AND CONDUCT
I agree to abide by all rules, policies, instructions and safety requirements established by Together We Golf, event organizers, instructors, coaches, host facilities, golf courses and simulator venues.
I understand that failure to follow applicable rules, safety requirements or instructions, or engaging in unsafe, disruptive, inappropriate or unsportsmanlike conduct, may result in immediate removal from an Activity without refund, credit or recourse.
DAMAGE TO PROPERTY
I acknowledge that I am responsible for any loss of or damage to property, equipment, facilities, simulator technology, golf carts or other assets caused by my intentional acts, negligence, misconduct or failure to follow instructions.
I agree to reimburse the owner or responsible party for the reasonable cost of repair or replacement resulting from such damage.
USE OF EQUIPMENT AND TECHNOLOGY
I understand that certain Activities may involve the use of golf simulators, launch monitors, cameras, sensors, radar systems, software, golf carts and other specialized equipment or technology.
I agree to use such equipment only as instructed by Together We Golf, venue staff, instructors or event organizers and acknowledge that misuse may result in removal from the Activity and suspension of participation privileges.
PERSONAL PROPERTY
I acknowledge that I am solely responsible for my personal property, including but not limited to golf clubs, bags, apparel, footwear, electronics, valuables and other belongings brought to an Activity.
The Organization shall not be responsible for any lost, stolen or damaged personal property.
REGISTRATION AND PARTICIPATION
In submitting this registration, I understand and agree to the following:
• The responsibility for ensuring my registration information is accurate and complete is mine;
• I will comply with all rules, instructions, policies and safety requirements communicated by the Organization and any host venue;
• My registration or participation is subject to approval by the Organization;
• Participation may be revoked or terminated at any time by the Organization, including for unsafe, disruptive, inappropriate or unbecoming conduct;
• I am responsible for reviewing and understanding any event-specific rules, policies or requirements applicable to the Activity in which I participate;
• I agree to abide by all applicable local, provincial and federal health and safety requirements; and
• I consent to receiving email communications from the Organization regarding events, activities, programs, leagues, clinics, lessons and community updates.
MEDIA RELEASE
In consideration for the Organization’s and its corporate partner’s services in sponsoring, organizing or facilitating Activities, I hereby grant and assign to the Organization and its corporate partners, without limitation, my individual television, radio, motion picture, print advertising, Internet, social media, promotional and all other related media rights specifically with respect to my participation in Activities.
MINOR PARTICIPANTS
For any Activity where the participant is a minor, the parent and/or legal guardian certifies that the information contained within the registration is true, that they are aware of the participant’s intention to participate in the Activity, and that the participant does so with their approval and consent.
The parent or legal guardian further agrees to be bound by the terms of this Waiver and Release on behalf of the minor participant.
GOVERNING LAW
I agree that this Waiver and Release and all terms contained within are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
I hereby irrevocably submit to the exclusive jurisdiction of the courts of Ontario.
Any litigation to enforce this Waiver and Release must be instituted in the Province of Ontario.
SEVERABILITY
If any provision of this Waiver and Release is found by a court of competent jurisdiction to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect and shall continue to be binding upon the parties.
ACKNOWLEDGEMENT AND CONFIRMATION
I confirm that:
• I have had sufficient time to read and understand each term in this Waiver and Release in its entirety;
• I understand that I am giving up certain legal rights, including the right to sue;
• I have agreed to the terms freely and voluntarily;
• I understand that this Waiver and Release is binding on myself and my Legal Representatives; and
• I confirm that I have reached the age of majority in the Province of Ontario where the Activities occur or will occur.
Code of Conduct Policy
Together We Golf (TWG) is committed to creating a welcoming, respectful, and inclusive environment for all participants. We ask every member of our community to treat fellow golfers, guests, staff, and course personnel with courtesy, professionalism, and respect.
Harassment, discrimination, intimidation, disruptive behaviour, or any conduct that negatively impacts the experience of others will not be tolerated.
TWG reserves the right to address any behaviour that is inconsistent with our values and community standards. Depending on the circumstances, this may include a warning, removal from an event, suspension of participation, or permanent removal from the TWG Community without refund.
By participating in TWG events, members agree to contribute to a positive, supportive, and enjoyable experience for everyone.
Cancellation Policy
Each Together We Golf (TWG) event requires a minimum number of participants to proceed. If the minimum registration requirement is not met, TWG reserves the right to cancel or reschedule the event. Participants will be notified as early as possible in the event of a cancellation or schedule change.
If you need to withdraw from an event, please notify us by email at togetherwegolf@gmail.com at least 14 days before the event date. Because tee times and event arrangements are secured with our golf course partners in advance, refunds cannot be provided for individual cancellations made within 14 days of the event. This policy applies regardless of the reason for cancellation, including illness, injury, emergencies, travel issues, work commitments, or scheduling conflicts.
Refund Policy
Participants who cancel more than 14 days before the event are eligible for a full refund. Cancellations received within 14 days of the event are not eligible for a refund. No refunds will be issued for no-shows.
Approved refunds will be issued to the original method of payment and processed within 3–5 business days.
If you are unable to attend, you may transfer your registration to another TWG Community member. It is the participant’s responsibility to arrange the transfer and notify TWG of the replacement attendee before the event. Please review all event details and dates carefully before completing your registration.
Inclement Weather Policy
Golf is played in a variety of weather conditions, and light rain or unsettled weather does not automatically result in a cancellation.
If the golf course determines that the round cannot be played due to weather or course conditions, rain checks will be issued by the golf course for the golf portion of the event, in accordance with the course’s policies.
Any scheduled meals, social gatherings, or non-golf event activities will proceed as planned unless otherwise communicated. All decisions regarding course playability and weather-related cancellations are made by the golf course’s professional staff and are final.
